Terms of Service

1. Service Description

MyBestOutfit is a mobile wardrobe management application available on iOS and Android, developed with React Native and Expo. The service includes: (a) a digital wardrobe with AI-powered background removal using Google Gemini; (b) AI-generated outfit suggestions based on weather, calendar, and style preferences; (c) personalized avatar creation and outfit visualization; (d) wardrobe analytics and statistics; and (e) optional shopping recommendations through affiliate links. The MyBestOutfit website (mybestoutfit.com) serves as the landing page and informational resource for the mobile application. MyBestOutfit is operated from Spain and subject to Spanish and European Union law.

2. Acceptance of Terms

By downloading, installing, or using the MyBestOutfit application, or by accessing the MyBestOutfit website, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you must not use our services. These terms constitute a legally binding agreement between you and MyBestOutfit in accordance with Ley 34/2002, de Servicios de la Sociedad de la Informacion y de Comercio Electronico (LSSI-CE) and applicable consumer protection laws.

3. User Obligations

By using MyBestOutfit, you agree to:

• Be at least 16 years old (the age of digital consent under Spanish law, Article 7 LOPDGDD).
• Provide accurate information when required (e.g., email for waitlist registration).
• Use the service only for its intended purpose of personal wardrobe management.
• Not attempt to reverse-engineer, decompile, or extract the source code of the application.
• Not use the service for any unlawful purpose or in violation of any applicable laws.
• Maintain the security of your device and account credentials.

4. Prohibited Uses

You may not use MyBestOutfit to:

• Upload content that is illegal, offensive, or violates the rights of third parties.
• Attempt to access or interfere with the AI processing systems beyond normal app usage.
• Use the app to collect data about other individuals without their consent.
• Redistribute, resell, or commercially exploit any part of the service without authorization.
• Use automated systems (bots, scrapers) to interact with the service.
• Circumvent or manipulate the subscription or AI credit system.

5. AI-Generated Content

MyBestOutfit uses Google Gemini artificial intelligence through the Firebase AI SDK for background removal, outfit suggestions, and avatar generation. You acknowledge and agree that: - AI-generated content (outfit suggestions, background removal, avatar images) is provided "as is" and may not always be accurate, appropriate, or aesthetically satisfactory. - AI outfit suggestions are recommendations only and do not constitute professional fashion advice. - AI processing is performed directly between your device and Google Gemini. MyBestOutfit does not guarantee the availability, accuracy, or quality of AI processing, which depends on Google's service. - AI features require an internet connection. Availability may vary depending on Google Gemini's service status. - MyBestOutfit strips EXIF metadata from photos before sending them to the AI, but the pixel content of images is processed by Google under its data processing terms. - You retain all rights to your original photos. AI-generated derivative content (e.g., background-removed images, avatars) is yours for personal use.

6. Subscriptions and Pricing

MyBestOutfit offers the following service tiers:

Subscriptions are billed monthly through Apple App Store (iOS) or Google Play Store (Android) via RevenueCat. Prices include applicable VAT. Prices may vary by region according to App Store / Play Store pricing tiers.

You may cancel your subscription at any time through your device's subscription settings (App Store or Google Play). Cancellation takes effect at the end of the current billing period. You retain access to paid features until the end of the period you have already paid for. No refunds are issued for partial billing periods, except as required by applicable consumer protection laws (Real Decreto Legislativo 1/2007). Upon cancellation, you return to the Free tier — no data is deleted, locked, or moved.

7. Affiliate Links Disclosure

MyBestOutfit participates in the Amazon Associates Program and may include affiliate links in shopping recommendations. When you click on an affiliate link and make a purchase, MyBestOutfit may earn a commission at no additional cost to you. Affiliate recommendations are based on anonymous style metadata (if you have opted in) and general wardrobe gap analysis. We clearly identify affiliate links within the app. The inclusion of affiliate links does not affect the objectivity of our wardrobe analysis or outfit suggestions. This disclosure is made in compliance with Article 20 of the LSSI-CE regarding commercial communications.

8. Intellectual Property

The MyBestOutfit application, website, brand, logos, UI design, original content, and underlying technology are the intellectual property of MyBestOutfit and are protected under Spanish intellectual property law (Real Decreto Legislativo 1/1996 — Ley de Propiedad Intelectual) and international copyright treaties. You are granted a limited, non-exclusive, non-transferable, revocable license to use the MyBestOutfit application for personal, non-commercial wardrobe management purposes. The AI models used (Google Gemini) are the property of Google LLC and are licensed to MyBestOutfit under separate commercial terms.

9. Your Content

You retain all ownership rights to the photos and content you create using MyBestOutfit. Since your wardrobe data is stored locally on your device, you maintain full control over your content at all times. MyBestOutfit does not claim any license or rights over your photos, wardrobe data, or personal information. We do not access, store, or process your photos on our servers — they travel directly from your device to Google Gemini for AI processing and are returned to your device. By using the optional affiliate recommendation feature, you consent to anonymous style metadata being processed to provide relevant suggestions. This does not grant us any rights over your personal content.

10. Limitation of Liability

To the maximum extent permitted by applicable law, including Real Decreto Legislativo 1/2007 (consumer protection): - MyBestOutfit is provided "as is" and "as available". We do not guarantee uninterrupted or error-free operation. - We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service. - We are not liable for the accuracy, quality, or appropriateness of AI-generated content, including outfit suggestions, background removal, or avatar generation. - We are not liable for the availability or performance of third-party services (Google Gemini, Apple App Store, Google Play, weather APIs). - Our total aggregate liability for any claims shall not exceed the amount you have paid for the service in the 12 months preceding the claim. Nothing in these terms excludes or limits our liability for fraud, gross negligence, or any liability that cannot be excluded under applicable mandatory law.

11. Service Availability

We strive to maintain continuous availability but do not guarantee uninterrupted access. The service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. AI features depend on Google Gemini's availability. Local features (wardrobe browsing, photo gallery, saved outfits) remain available offline. We reserve the right to modify, suspend, or discontinue any part of the service with reasonable notice. In case of permanent discontinuation, we will provide at least 30 days' notice to allow you to export your data from the local database.

12. Modifications to Terms

We may modify these Terms of Service at any time. We will notify you of material changes through the app and/or by updating the "Last updated" date on this page. Continued use of the service after changes constitute acceptance of the modified terms. For substantial changes that affect your rights, we will provide at least 30 days' notice before the changes take effect, as required by applicable consumer protection laws.

13. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the Kingdom of Spain and applicable European Union regulations, including but not limited to: - Regulation (EU) 2016/679 (GDPR) - Ley Organica 3/2018 (LOPDGDD) - Ley 34/2002 (LSSI-CE) - Real Decreto Legislativo 1/2007 (Consumer Protection) - Real Decreto Legislativo 1/1996 (Intellectual Property) Any mandatory consumer protection provisions of your country of residence that provide greater protection shall also apply.

14. Dispute Resolution

We encourage you to contact us first at legal@mybestoutfit.com to resolve any dispute amicably. For consumers resident in the European Union, you may submit a complaint through the European Online Dispute Resolution Platform (ODR) at https://ec.europa.eu/consumers/odr. If amicable resolution is not possible, disputes shall be submitted to the courts and tribunals of the domicile of the consumer, in accordance with Article 52 of the Ley de Enjuiciamiento Civil and applicable EU consumer protection directives.
